Policy: Use of Web Sites and Other Services
Our site is designed to provide information and access to Artisan products for your own personal use and pleasure. By accessing and using this site, you agree that CraftsFrance and Shouette USA (both referred to as Shouette below) and its associated companies, affiliates, partners and clients are held free of any liability of any kind associated with the information or actions taken on this site.

By utilizing any Shouette website, phone or fax services, you hold Shouette free and clear from all claims arising from any act or default (whether arising from negligence or any other manner) by Shouette or by any Artisan or Association associated in any way with Shouette. Shouette does not buy, purchase or otherwise own any products shown or provided on our sites, unless specifcally identified. All Customers are dealing directly with the Artisan or Association in regards to all purchases made. Shouette performs on behalf of Customers and Artisans/Associations to facilitate the purchase of Artisan goods, provide information regarding Artisans, their goods and other related, relevant or not, information, including but not limited to shipping, packaging, rates, prices, customs duties, timeframes, processes and other information.

Shouette’s total liability for any claims by any Customer from any act or default (whether arising from negligence or otherwise) shall not exceed the price of goods supplied by the Artisan though services offered by Shouette to the Customer. We reserve the right to adjust prices. Artisan products made available through Shouette services are subject to availability as determined by the Artisan.

GENERAL CONDITIONS : Purchasing, Ordering and Use of Services
The following provisions establish the general sales conditions for products offered by Artisans, to Customers residing and receiving packages in the USA, though services offered by Shouette on its web site at the following addresses :

Artisan, Artisans and Artists refer to any entity (individual, association, business entity or other) that provides products or services for sale to any Customer, through Shouette services. Shouette refers to any entity owned or managed (including web sites and domain names) by Shouette USA, including but not limited to CraftsFrance, CraftsFrance.com, Shouette France, Shouette and Shouette USA. Customer refers to any individual or entity that utilizes Shouette services, via its web sites, phone, fax or other means. Shouette states, and Customer agrees, that it is not possible to purchase any goods without accepting the general conditions as detailed in this document.

  1. The General Sales Conditions constitute all the rights and obligations of the parties and no other General Conditions can be integrated into these.
  2. The rights and obligations of the parties are governed under the laws of the United States of America.
  3. The fact that a Customer fills in a purchase order via our the web-site(s) or through other services offered by Shouette, and confirms the order (by clicking on the "Purchase" button or any button indicating a desire to buy products, then in the SSL part), implies full and complete acceptance of the present Sales Conditions.
  4. The web-sites contain at all times a commercial offer of sale for products which is not considered, from a legal point of view, as a permanent offer. Therefore a contract is only concluded if it is confirmed by the Artisan via Shouette services. The possible refusal to accept an order may be confirmed by return email or phone call within 5 business days (USA and French national holiday, weekends and other days posted on our sites are not business days) at the latest. Furthermore Shouette reserves the right of not registering a payment and therefore of not confirming an order for any reason whatsoever.
  5. Shouette provides information to the Customer provided by a variety of sources including the Artisan, local tourist bureaus, various printed materials and other means. Shouette and Artisans are not held liable for any misprints, inaccuracies, misrepresentations, out of date materials or other information provided. Shouette has used its best efforts to verify all information relating to information provided by Artisans and believes the information provided via our sites or through other means to be accurate and truthful.
  6. The prices indicated are those in effect at the time of browsing the web site and are verified through a confirmation available on the web site at the time of purchase or through other means of confirmation as may be used from time to time. If a discrepancy should appear between the invoice sent along with the product package and the original confirmation, the original confirmation shall be the document of record. Shouette should be contacted immediately if any discrepancies exist. It is the sole responsibility of the Customer to notify Shouette of any discrepancy. All prices, fees and other monetary amounts are expressed in US Dollars unless explicitly noted. Prices expressed in Dollars are subject to change. The applicable prices and fees (if applicable) are calculated including all taxes and shipping but will NOT INCLUDE CUSTOM’S DUTIES, if any shall apply. It is the sole responsibility of the Customer to pay any charges or fees associated with US Customs Duties, per regulations. The applicable prices are calculated excluding French VAT for the consumer residing outside of the European Union (EC).

    Shouette has provided general information as a courtesy, via its web site, regarding US Customs for the personal use of Customers. Shouette and Artisans are not liable for any errors, changes, inaccuracies or other misrepresentations in this material and shall not be liable at any level for any damages, charges, fees or costs associated with Customs Duties or usage of the information provided.

  7. The sale becomes final after acceptance by Shouette, or its associate services, suppliers or affiliates, for the services for the transaction of secured on-line payments. The acceptance and confirmation of the order are carried out by data and information provided by you, the Customer. The customer may retract his purchase order during the 24 hours immediately following the purchase submission upon direct notification (and returned confirmation) via email or via in-person phone conversation with Shouette. If the item has already been shipped or mailed, Customer may accept the package or may return it to Shouette for further processing. Please note that if the item has already been shipped during this period, the Customer will not be credited back the purchase amount until the item has been received by Shouette. In addition, the Customer acknowledges that they understand that they are responsible for all shipping, handling and insurance charges and Customs Duties, if any, including the charges associated with the mailing or shipping from France and the charges for shipping the item to Shouette USA. In other words, all Transport costs and other costs (taxes, duties, etc.) for the acceptance and then return of products to Shouette are charged to the Customer. Customer agrees to send items to Shouette within 3 business days of receipt of items and to insure the item for its full retail value. If the item should be damaged in transit to Shouette USA, the Customer agrees to participate fully in the process of collection of insurance. If the Customer has purchased shipping/mailing insurance through Shouette and if an item should be damaged in transit (as verified by Shouette), Shouette will arrange to have a substitute item sent to Customer. The Customer is responsible for all Customs Duties on the repeat shipment (and may apply for a refund on the original package, if charges applied) but is not responsible for shipping charges on the repeat shipment. The original damaged product should be sent back to Shouette COD (or through other method agreed in advance) in its original packaging, without alteration of any kind. Insurance will be paid directly to Shouette or to the Artisan, as appropriate. If no insurance is purchased by the Customer, no replacement product will be offered.
  8. Confirmation of the ordered goods, their price, terms of payment and also the mode of delivery, shall be included on a confirmation, sent by e-mail or other means. A copy of the Confirmation will be maintained by Shouette and will be available to the Customer upon request. Currently, all purchases made through the services offered by Shouette must be paid for utilizing a credit card. Immediate payment by credit card (Visa, Master Card), made secure by SSL technology, will require the credit card number and the experation date, as well as the name printed on the card. The Customer confirms that they are 18 years old or older and have authorization to utilize the card and to make the payment chosen. In the context of a payment by credit card, the payment order can be revoked in case of fraudulent use of the card, in accordance with the agreement made between the consumer and their bank.
  9. To ensure proper processing of the order, personal data from the Customer will be collected and shall undergo computer processing. Data collected may be kept in whole or in part on servers, in data bases and in other means as determined by Shouette. The Customer acknowledges having knowledge of this. Shouette will not communicate this information to third persons not authorized under this agreement without the consent of or notification to the Customer.
  10. The products are delivered to the place of delivery indicated in the purchase order. If possible, Shouette services will indicate the expected timeframe for delivery however Customer acknowledges that the timeframes provided are only estimates and are not controlled by Shouette. Shouette will use its best efforts to indicate a reasonable timeframe for order, production, packing, mailing and customs examination.
  11. The transfer of risks concerning products takes place when they are handed over by the Artisan to the carrier, shipping agent or other transport. The products travel at the Customer's risk. Shouette recommends that Customer purchase appropriate insurance to cover potential damage or loss of the item. To this end, in most cases, Shouette will indicate shipping/mailing charges that include appropriate insurance. Customer will have the option of opting-out of this insurance in some cases.
  12. Shouette guarantees that the products are made in France (unless explicitly identified prior to purchase) and that they have undergone all the necessary care in order to ensure their conformity to the description given on the web-site at the date of the order. However, taking into account the hand-made nature of certain products, the physical characteristics can vary and Customer is informed that slight imperfections, differences in color, and other unique aspects will be present in each piece. PLEASE NOTE THAT EACH PIECE IS UNIQUE AND MADE ON DEMAND BY THE ARTISAN AND THEREFORE NO TWO (OR MORE) PIECES WILL BE EXACTLY ALIKE. This is the only guarantee granted by Shouette. No other guarantee written or tacit is granted. In particular, Shouette shall not be able to guarantee that the products meet the specific expectations of the customer.
  13. The information contained in this Site including all images, illustrations, designs, photographs, writings and other materials that appear herein are copyrights, trademarks, trade dress or other intellectual property owned, controlled, or licensed (all of which, collectively, are herein referred to as the "Content") by Crafts France and/or Shouette USA or its subsidiaries and affiliates or are the property of their respective owners. The name Crafts France, CraftsFrance.com and the Crafts France logo are owned and copyrighted by Shouette USA. Use of any content without the expressed consent of Crafts France is prohibited.
  14. The Customer is solely responsible for the choice of the products and for understanding this policy, including all aspects as to the delivery and of their use. In this respect, the Customer's attention is drawn to the fact that s/he should not utilize the product in manners not generally understood, indicated on the labeling, nor if it seems that the products are deteriorated or damaged in any manner. Under no circumstances can Shouette be held responsible for any damages or liability due to this fact. Likewise Shouette cannot be held responsible for non respect of the legislative or statutory measures in force in the countries where deliveries are made or where the product may end up being utilized.
  15. If a dispute arises from the present contractual relation, the parties undertake, before taking any legal action, to look for an amicable solution. All disputes arising from the present contract, or from any other aspect related to use of Shouette sites, products purchased through services offered by Shouette or for any other related manner will be submitted to mediation and, if needed, arbitration as determined and in a place so chosen by Shouette, or through the legal remedy in San Francisco, CA, USA.
